Introduction
SocialMart respects the intellectual property of others and is committed to providing a platform that protects the rights of content creators and copyright holders. This Copyright Policy outlines how we handle copyright issues and how to report potential infringements.
Protecting Copyright
- User-Generated Content: When you upload original content to SocialMart, you retain ownership. However, to facilitate our services, you grant us a limited license to use, display, and modify your content as necessary to operate the Platform.
- Respect for Intellectual Property: You must not upload or share any content that infringes on the copyrights, trademarks, or other intellectual property rights of any person or entity. This includes unauthorized copies of copyrighted works of any kind.
- Authorization: By posting content, you confirm that you either own the copyright or have the necessary rights or licenses from the copyright holder to use and distribute that content on our Platform.
Reporting Copyright Infringement
If you are a copyright holder or an authorized representative and believe your work has been infringed on SocialMart, please submit a formal Notice of Alleged Infringement. This notice must include:
- Clear identification of the copyrighted work you believe has been violated.
- Specific description of the material you claim is infringing, including its location on our Platform (with a link if possible).
- Your contact information (name, address, phone number, email).
- A statement that you believe, in good faith, that the use of the material is unauthorized by the copyright holder.
- A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
- A physical or electronic signature of the copyright holder or authorized representative.
Our Response to Copyright Notices
- Prompt Action: We take copyright infringement seriously. Upon receiving a valid Notice, we will investigate and take appropriate actions, which may include removing or disabling access to the infringing material.
- User Notification: We will notify the user responsible for the content in question, informing them of the removal and the reason behind it.
- Counter-Notification: If a user believes their content was removed in error, they may submit a counter-notification in writing. We will evaluate the counter-notification and, if appropriate, restore the removed content.
Repeat Infringers
SocialMart takes repeated copyright violations seriously. Users with multiple infringement claims could face account suspension or termination.
